We respect your privacy and therefore any personal information, vehicle details and location data, obtained through the use of the app is subject to the terms and conditions as set out in our Privacy Policy. Our Privacy Policy explains how, why and when we, access, collect, use, share and store your personal information. By using the app you acknowledge and agree to the terms of the Privacy Policy set out below.
The Privacy Policy relates to the collection and use of personal information details you may supply to us through your use of the app and such policy, therefore, governs the manner in which your personal information will be dealt with.
- “Background” is the instance where your app is open but not on-screen of your mobile device;
- “Client”is someone who has an active short-term insurance policy with us. This includes any members of the client’s family, agents or employees who are covered under their policy.
- “Foreground” is the instance where your app is open and on-screen of your mobile device;
- “Instruction” shall mean a work request provided to you by an OUTsurance rescue advisor, for you to attend to a call out and to provide the specified service requested by the client.
- “Location data” means the area which can be tracked via the location services settings (GPS) on your device.
- “Personal information” for the purposes of these Terms and Conditions means all information specific to you, which is provided to us through your use of the app. In other words, information that identifies you (assigned the same meaning as contained in the Protection of Personal Information Act 4 of 2013 as amended). This includes but is not limited to the following personal information that you may provide to us during the use of the app:
- Your name and surname;
- RSA identity number or date of birth;
- Telephone numbers;
- Physical address;
- E-mail address;
- Vehicle description and details;
- Location Information
- “Privacy policy” shall mean this policy read including any annexures thereto and which should be read in conjunction with our Terms and conditions in relation to the app.
- “Rescue Advisor” – means a staff member within the rescue department who is employed by OUTsurance
- “Service Provider” shall mean you as the authorised and contracted third party, individual or entity who is registered as part of the OUTsurance panel of approved service providers that we have engaged to provide some or all of the services offered on our behalf via the app, and shall include your employees, representatives, subsidiaries, affiliates and agents.
- ”The App” means the application designed by us, which you will utilise to offer our client’s easy access and hassle free roadside and locksmith assistance at the touch of a button, from any location within the borders of the Republic of South Africa.
- The words "us", "we" or "our" refer to OUTsurance Insurance Company Limited.
- The words "you" “user” or "your" refer to the service provider.
- The word “them” refers to the client.
By the use of the app, you hereby consent and acknowledge that we may share your information, or part thereof with a client solely for the purpose of providing the services to them. Should you not consent to the below you will not be able to receive or accept an instruction given to you via the app.
You expressly consent to the Access; Collection and Use of:
- your personal information (i.e. name and cell phone number);
- your vehicle registration details;
- your location data. You must activate your location services settings (GPS) on your device. If you fail to activate your location services setting (GPS) you will not be able to use the app.
You expressly consent to the sharing of the below information with us and the client:
- your personal information (i.e. name and cell phone number);
- your vehicle registration details;
- your location data to allocate an instruction to you to assist a client, and to allow the client to track the status of your whereabouts and allowing them to make contact with you if required. The app will continue to collect your data in the background.
Accessed:
- your location data is accessed via a secured interface that's integrated to the Android and IOS software development kit's (sdk’s).
- your personal information (i.e. name and cell phone number) and vehicle registration details are accessed via HTTPS.
Collected:
- your personal information (i.e. name and cell phone number) and vehicle registration details will be collected in the foreground via the SP web registration process;
- your location data will be collected in both the background and foreground;
Used:
- to determine your location data so as to establish how close you are to the client, in order for us to provide an instruction to assist the client on our behalf;
- your location data is used to track your location on- route to a client in order to determine your expected time of arrival (ETA) if you have accepted the instruction given by us to assist the client;
- your personal information (i.e. name and cell phone number) and vehicle registration details are used for authentication purposes and identity verification so that you can be identified as our approved service provider;
- your personal information (i.e. name and cell phone number), vehicle details and location data will be continuously used in the background even when you are not actively using your app.
Shared:
- your personal information (i.e. name and cell phone number), vehicle registration details and location data will be shared securely over HTTPS.
We have the highest regard for the privacy of your personal information obtained through the use of the app, and therefore undertake that your personal information, vehicle details and location data shall only be accessed, collected, used and shared solely for the specific purpose, which is the use of the app.
We will not sell, rent or provide your personal information, vehicle details and location data to unauthorised entities or other third parties, for their independent use, without your consent.
We undertake to take reasonable steps and implement the appropriate security safeguards to protect your personal information, vehicle details, and location data from unlawful disclosure, loss, misuse or unauthorised alteration.
You acknowledge and consent that we may store your information in perpetuity within the Republic of South Africa for statistical, historic or research purposes. Your information will be stored in our Cloud database systems that have built-in safeguards to ensure the privacy and confidentiality of that information.
However, your location data will be forwarded to our BFF core system. Our BFF core system does not store any data, neither will it be shared with any unauthorised entities or other third parties. After a few hours your location data will expire and be deleted from our database.
In this regard, although we will take all precautionary measures to protect your data, we cannot guarantee the security of any data that you disclose. You therefore accept the inherent risk of providing the data when using the app and will not hold us, our directors, shareholders, employees or agents responsible for any breach of security.
The following are the instances when we will be entitled to disclose the personal information obtained from you:
- When any regulatory authority requests same;
- To comply with any regulation passed under relevant legislation or any legal process;
- To enforce and protect our rights and property (including intellectual property);
- To prevent or combat any criminal activity,
- When you have expressly authorised us to do so,
- When we are permitted to do so under any laws of the Republic of South Africa.
If at any stage, after you have given us your consent, you no longer wish that we use your personal information, vehicle details and location data, you may withdraw your consent by de-registering and uninstalling the app from your mobile device.
We reserve the right in our sole discretion to amend this Privacy Policy from time to time. You agree to review the Privacy Policy whenever you visit the app for any such amendments. Save as expressly provided to the contrary in this Privacy Policy, the amended version of the Privacy Policy shall supersede and replace all previous versions thereof.
